HowFarApp Terms of Use

Welcome to HowFarApp! These Terms of Use ("Terms") govern your access to and use of the HowFarApp web and mobile platform (the "Platform"), including any content, functionality, and services offered on or through the Platform. HowFarApp is operated by HowFarApp Limited a Ini3ium Limited Comapny. ("we," "us," or "our"), a company registered in Nigeria under the Companies and Allied Matters Act (CAMA) 2020.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform. These Terms incorporate our Privacy Policy, which explains how we handle your data in compliance with the Nigeria Data Protection Act (NDPA) 2023.
1. Eligibility
You must be at least 16 years old to use the Platform, or have parental/guardian consent if under 16. You may not use the Platform if you are barred under applicable laws. By using the Platform, you represent that you meet these requirements.
2. Account Registration
To use certain features (e.g., messaging, bill payments, etc.), you must create an account with accurate information (e.g., name, phone, email). You are responsible for maintaining your account's security (e.g., password confidentiality) and all activities under it. Notify us immediately of any unauthorized access at support@howfarapp.ng We reserve the right to terminate accounts for violations.
3. Platform Services
HowFarApp provides:
· Social Features: Timelines, messaging, groups, events, live streaming, and free voice/video calls.
· Financial Services: airtime, data, and utility bill payments (via third-party providers).
· Earning Opportunities: Affiliate programs, marketplace sales, and content monetization (e.g., commissions on referrals).
All services are provided "as is" without warranties. We may modify or discontinue features at any time.
4. User Content
You retain ownership of content you post (e.g., posts, messages, listings), but grant HowFarApp a non-exclusive, royalty-free license to use, display, and distribute it on the Platform. You are responsible for your content; it must not violate laws (e.g., Cybercrimes Act 2015) or infringe rights (e.g., no hate speech, fraud). We may remove violating content without notice.
5. Prohibited Conduct
You agree not to:
· Use the Platform for illegal purposes (e.g., money laundering, per CBN AML regulations).
· Post harmful content (e.g., spam, viruses, and misinformation).
· Impersonate others or misuse features (e.g., fake accounts, automated bots).
· Interfere with the Platform (e.g., hacking, overloading).
· Violate intellectual property or privacy rights.
Violations may result in account suspension, legal action, or reporting to authorities (e.g., NFIU for suspicious activities).
6. Bill Payments and Financial Transactions
Bill payments are facilitated by licensed third parties. We do not store financial details (tokenized for security). Transactions are subject to provider terms and fees. Discounts are capped user/month. We are not liable for transaction errors or disputes—contact providers directly.
7. Earning and Affiliate Programs
You may earn through affiliates (commissions) or marketplace sales. Earnings are paid via verified methods (e.g., bank transfer, etc.), subject to taxes and compliance (e.g., TIN verification, etc.). We deduct fees (e.g., 10-20% platform cut) and reserve the right to withhold for violations.
8. Intellectual Property
The Platform, including logos, designs, and code, is owned by HowFarApp and protected by Nigerian copyright laws. You may not copy, modify, or distribute without permission.
9. Disclaimers and Limitations of Liability
To the extent permitted by applicable law, including the Federal Competition and Consumer Protection Act (FCCPA) 2018, the Platform is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
We are not liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, including but not limited to lost profits, loss of data, or business interruption, arising from your use of the Platform, even if advised of the possibility of such damages. This limitation applies to the fullest extent allowed by law.
For damages arising from our negligence or breach of duty, our liability is governed by the FCCPA and other applicable laws, and we do not exclude or limit liability where it would be unlawful to do so (e.g., for death, personal injury, or defective services).
We are not responsible for any issues, losses, or damages caused by third-party services integrated with the Platform (e.g., downtime or errors in payment processing, etc.), as these are governed by their respective terms. We recommend reviewing their policies.
In any event, our total liability for any claim arising from these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, to the extent permitted by law.
If any part of this limitation is found invalid or unenforceable under applicable law, it shall not affect the validity of the remaining provisions.
10. Dispute Resolution
Disputes will be resolved through arbitration in Abuja under the Arbitration and Conciliation Act. Governing law is Nigerian law.
11. Termination
We may terminate your access for violations. Upon termination, your data may be deleted, subject to NDPA retention rules.
12. Governing Law
These Terms are governed by Nigerian law. If any provision is invalid, the remainder remains in effect.
